WAIVER OF LIABILITY FOR STORAGE OF VESSEL

Namolokama O’ Hanalei Canoe Club (“NCC”) maintains storage racks on its club site suitable for storing OC-1 and similar sized vessels. It relies for its existence primarily upon membership dues and donations. As a means of raising money in support of NCC, it encourages donations by allowing donors (the “Vessel Owners”), especially those who are also members, at their own risk, to use spaces in the racks for temporary storage of their respective vessels.

The undersigned Vessel Owner understands and acknowledges that the NCC site is located in an area that occasionally floods and that NCC has no provision for security of any kind for the vessels stored at the NCC site. NCC has no provision for surveillance or for policing the site against bad acts of its members or trespassers on the NCC site that might cause damage or loss of the stored vessels. It carries no insurance against such damage or losses. Such potential damage or loss, from whatever cause, is solely at the risk of the Vessel Owner and in no way the responsibility of NCC, its officers, members, coaches, landlord, etc. This is true despite the donated payment of the Vessel Owner to NCC to be allowed the use of the rack space assigned by NCC to the Vessel Owner.

Use of the space is on a “where is, as is” basis. The presence of any such vessel on the NCC site for which no donation has been made shall be considered a form of squatting or trespassing, entitling the Vessel Owner to no duties from NCC whatsoever. Such a vessel, at the option of NCC, may be summarily removed from the racks and/or from the NCC site without liability to the Vessel Owner.

I understand and agree that once I have paid my fee for storage offered to me previously by arrangement with the club, and having signed this agreement, I may store my vessel at the NCC site subject to the terms herein.
